Terms of service

Notice. This English translation is provided for informational purposes only. In the event of any discrepancy between the French and English versions, the French version shall prevail.
1. Agreement
These terms govern your use of Mortemain, a monitoring service published by Laurent Gentil EI (SIREN 990560633), referred to here as "we" or "us". By creating an account or using the service, you agree to them. If you use Mortemain on behalf of an organisation, you confirm you are allowed to bind it.
2. What Mortemain does
Mortemain watches for the check-ins your jobs are supposed to send and alerts you when one is late or missing. It is a monitoring aid, not a substitute for your own safeguards. It does not run, fix, or control your jobs.
3. Beta, changes, and third-party integrations
Mortemain is a beta service and evolves over time; we make no commitment of uninterrupted availability. We reserve the right to add, change, or remove features at any time. Mortemain works alongside third-party tools and channels you choose to connect (for example your job runners, Slack, Telegram, ntfy, or your own webhooks). If such an integration stops working because a third party changes, deprecates, or restricts its software, API, or policies, that is not a defect in Mortemain. We are also not responsible for any fees or charges you incur with a third party as a result of connecting it to, or using it with, Mortemain.
4. Your account and acceptable use
Keep your credentials and ping URLs secret; you are responsible for activity under your account. Do not use Mortemain to break the law, to send unlawful or abusive content through alerts, to overload or probe the service, or to resell it without our agreement. We may suspend accounts that put the service or other users at risk.
5. Plans, pricing and billing
The free tier is free. Paid plans, when available, are billed in euros for the period you choose. Founding rates, where offered, apply as described on the pricing page. You can cancel at any time; access continues to the end of the paid period.
6. Provided as is, no warranty
Mortemain is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law. In particular, we do not warrant that every missed or failed run will be detected, or that every alert will arrive on time, across channels and networks outside our control. You remain responsible for your own systems and for keeping independent safeguards for anything important. Mortemain is not designed or intended for safety-critical or life-critical systems and must not be used for them; we accept no responsibility for any such use.
7. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising from an undetected failure or an undelivered alert. Our total liability for any claim is limited to what you paid us for the service in the twelve months before the claim, which on the free tier is zero. Nothing here excludes liability that cannot be excluded by law.
8. Service continuity and discontinuation
Mortemain is run by a single operator. We do not guarantee that the service will remain available indefinitely. We may suspend, wind down, or discontinue it at any time, including in the event of the operator's incapacity, death, insolvency, bankruptcy, or cessation of activity. Where circumstances allow, we will give reasonable advance notice and a window to export your data; in some events that may not be possible. To the extent permitted by law, we are not liable for any loss arising from the suspension or discontinuation of the service.
9. Your data
How we handle your data is set out in the privacy policy.
10. Termination
You may stop using Mortemain and delete your account at any time. We may suspend or end access for a serious or repeated breach of these terms, or where the law requires it. On termination, your data is deleted according to the retention rules in the privacy policy.
11. Changes
We may update these terms as the service evolves. The new version will be published on the mortemain.com website; continuing to use Mortemain after that means you accept them.
12. Governing law
These terms are governed by French law. If a dispute cannot be settled amicably, it will be brought before the competent French courts, subject to any mandatory consumer protections that apply to you.
